Neoliberalism can be considered an ideology that believes that free trade and investment are the sole source of economic development and prosperity. This idea is based on the principle that the market mechanism should govern the human destiny. The collision of neoliberalism and the second generation of human rights, based on the charles and abstract categories that are abstract and academic, are in the economy and the market. The rules that are classified in this generation are among the legal ones that, in terms of codification and legislature, coincide with the rules of the first generation, but its identification is philosophically and theoretically followed by civil and political rights. It is important for these rules and concepts to coincide with the emergence of the period of neoliberalism, partly due to the international system's desire to realize the justice of the economy, and consequently to reduce poverty and overcome the shortcomings and deprivations of mankind.}, keywords = {politics,Liberalism,Neoliberalism,charter of international law,second generation human rights}, title_fa = {بررسی نسبت نئولیبرالیسم و نسل دوم حقوق بشر}, abstract_fa = {نئولیبرالیسم از جمله اندیشه‌هایی است که بر مفاهیمی چون بازار، حذف مقررات و حذف مفهوم نفع عمومی یا اجتماع و جایگزینی آن با «مسئولیت فردی» می‌پردازد. نئولیبرالیسم را می‌توان ایدئولوژی درنظر گرفت که معتقد است تجارت و سرمایه‌گذاری آزاد یگانه منبع توسعه و شکوفایی اقتصادی است. این اندیشه بر این پایه استوار است که مکانیسم بازار باید اداره‌کنندة سرنوشت بشر باشد. تلاقی نئولیبرالیسم و نسل دوم حقوق بشر براساس دسته‌بندی‌های کارل واساک که انتزاعی و آکادمیک است، در اقتصاد و بازار است. قواعد طبقه‏بندی‌شده در این نسل از جمله حقوقی‌اند که از نظر قانونگذاری و کدگذاری، همزمان با قواعد نسل اول پدید آمدند، اما شناسایی آن به لحاظ فلسفی و نظری پس از حقوق مدنی و سیاسی است. این قواعد و مفاهیم از آن روی حائز اهمیت است که با پیدایش دورۀ نئولیبرالیسم همزمان بوده و با توجه به خواست نظام بین‌الملل مبنی بر تحقق عدالت که اقتصاد و به‌تبع آن کاهش فقر و غلبه بر کمبودها و محرومیت‌های بشر است، بخشی از آن است.}, keywords_fa = {سیاست,لیبرالیسم,منشور حقوق بین‌الملل,نئولیبرالیسم,نسل دوم حقوق بشر}, url = {https://jpq.ut.ac.ir/article_77520.html}, eprint = {https://jpq.ut.ac.ir/article_77520_34adaf69d45af55c5397c8f159aac36a.pdf} }
